Welcome to Alertus, New Zealand’s very own emergency contact service. These terms and conditions are intended to assist in making Alertus a safe and secure place to input and store emergency contact information.

Alertus takes every care to ensure that information published on this website is accurate when posted and is regularly updated but does not guarantee the accuracy or completeness of such information and may change the information at any time without notice.

The contents of this website should not be construed as legal advice. If in doubt you should speak to your professional legal advisor.

You use this website at your own risk. Alertus will not be liable for any loss or damage which you may incur as a result of using this website and does not promise that this website will always be available or that access will be uninterrupted or free from failure. Neither can it promise that transmitted information will not be lost or that viruses or other destructive materials will not be sent.

These Terms and Conditions and the information contained on the Website set out the basis upon which Alertus will provide the emergency contact database service to you, the customer. No other terms and conditions shall apply to the provision of the services.

By registering as an Alertus member you accept these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the Services.

Definition of Terms

Services:
means to any one or more of the services offered by Alertus as described on our website.

Alertus Database:
means to the database of emergency contact details throughout New Zealand that is used and maintained by Alertus.

Emergency Contact:
means to the listed name and contact details of the person whom you identify as someone to be contacted on your behalf during an emergency.

Terms:
refers to these Terms and Conditions.

Website:
refers to the Alertus website at https://alertus.co.nz

Registering for the service

You can register for any one of the Alertus emergency contact services on our website at alertus.co.nz or by phoning 0800 201-201 24 hrs a day- 7 days a week. Registrations that have been made via the website will be activated on receipt of payment.

Payment

Registration for any of the Alertus emergency contact services will only be activated once payment of the applicable fee has been received. Details of the fees can be found on the website.

If you are registering online via the website you will be asked to make an online payment at the time of registration. Payment can be made by Visa or Mastercard using Paypal or by internet banking into the Alertus bank account.

Please ensure you enter your property ID number, street number and address into the reference fields of your direct deposit so Alertus can easily identify and reconcile your account.

Password and login details

You will be issued with a login name and password. This will be sent to you via email or post.

If you forget or loose your password please visit the Alertus website, or call 0800 201- 201, and request a new password to be sent to the email address or postal address registered on the Alertus emergency contact database.

For security purposes you will be required to correctly answer a security question before the new password will be sent to your email or postal address.

NOTE: If you cannot correctly answer any of these questions you will not be sent a new password but asked to re-register your property on the Alertus emergency contact database and pay for the registration.

Please keep your login name and password safe and do not disclose them to any other person. Any changes or payments made using your login name and password will be assumed to have been made by you. We are not responsible for any loss you suffer as a result of any unauthorized use of your login name or password.

Changing your mind

If you change your mind and decide that you do not want to register for the Alertus emergency contact system, you can write to us by registered post requesting that your registration is cancelled. Provided that we receive such cancellation notice within 14 days of the date of your registration, we will cancel the registration and return all fees paid to you.

Information provided by you

Any information you supply Alertus for inclusion on the Alertus emergency contact system database must be true and accurate. We are not responsible for any loss you suffer as a result of inaccurate information given by you.

You must ensure that you have permission from your emergency contact person(s) to supply Alertus with their contact details. You must also inform them that their information will be held on the Alertus emergency contact database and advise them who will have access to the information.

More information about how information provided by you will be used is contained in our privacy policy. If you are unable to obtain the privacy policy from the website, a copy can be obtained by emailing Alertus at [email protected] or by calling 0800 201-201.

Accurate information

You have a responsibility to inform us if any of the details you provide to us change at any time. For the Alertus emergency contact system to be effective, we need current and accurate contact details.

You can update or change your details held on the Alertus emergency contact database at any time via the website using the login name and password that we have provided to you.

You can write to us to request we remove all your details from the Alertus emergency contact database at any time. However, unless such request is received within 14 days of your registration, we will not refund to you any fees that you have already paid.

Renewing the service

All registrations will expire after one year unless the appropriate renewal fees are paid. We will send you a reminder notice at least one month before your registration is due to expire. Payment of renewal fees can be made online bank deposit or via credit card.

Please refer to the renewal notice or the website to see the fees that apply at the time of a renewal as they may have changed since the time of your first or previous registration. Your renewal notice will indicate the appropriate renewal fee payable.

Please be aware that if we do not receive payment of the renewal fees within one month of the expiry date of your registration your details will be deleted from the Alertus emergency contact database.

How will we use the information you supply to us

The information you provide us will be stored on the Alertus emergency contact database. This information will be kept secure in accordance with the requirements of the New Zealand Privacy Act 1991.

Information that you provide will be used by us in order to locate a nominated emergency contact person(s) for your property in the event of an emergency. The information that you provide us will be accessible by Police, Fire and Ambulance service communications centres.

Other than stated in these terms we will not sell or allow third parties access to your personal information without your consent.

We may use your contact information to provide you with details of other services we provide or to send to you crime related and other useful information. If you do not wish to receive this information please email us at [email protected] or write to us and let us know.

Our liability

You agree that, to the maximum extent permitted by law, any and all liability and responsibility of Alertus to you or any other person under or in connection with these terms and conditions, or in connection with the services, this Website, another Member’s acts or omissions, or your use of or inability to use, the services or this Website, is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise.

Alertus’ liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.

Indemnity

You agree to release, indemnify and keep indemnified us from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your failure to comply with these terms and conditions, or arising out of any content or item you submit, post, transmit, or make available through the Alertus services.

Using the website

We cannot guarantee the accuracy or completeness of any information contained on the Website and we are not responsible for any damage or loss you suffer as a result of the use of or reliance on any of the information on the Website.

Alertus does not guarantee that the services provided will be uninterrupted, timely, secure, or error free. Alertus does not warrant that any information provided on the Website is error-free or reliable.

You understand and agree that any material and/or data downloaded or otherwise obtained by you from the Website is done at your own risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.

Security of your login information

You are responsible for keeping your login information, including your email address and password, secret and secure. Without limiting the foregoing, you agree:

  • not to permit any other person to use your user name or membership; and
  • not to disclose, or provide to any other person, your password, email address, date of birth or any other information in connection with your membership that may allow them to gain access to your membership.

We are not responsible for the availability of such external sites or resources and do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. We are not responsible for any loss or damage you suffer as a result of visiting any website via the links on the Website.

Our intellectual property

All the intellectual property rights in the design and content of the Website and in the Alertus emergency contact database are owned by or licensed to us. You may download, print and view this information for your personal use but you must not copy the information for the purpose of distributing it to third parties or use the information in any commercial context (other than in relation to the provision of the services to your business).

If you seek to reproduce or otherwise use the content in any way it is your responsibility to obtain approval for such use where necessary.

The intellectual property rights comprised in any of the sites which can be reached via a link on the Website is owned by third parties. You must not download or copy any of this information unless you are permitted to d so by the owner of such intellectual property rights.

All other use, copying or reproduction of this website or any part of it is prohibited (except to the extent permitted by law). None of the content or any part of it may be reproduced on any other Internet website.

Alertus is the owner of several registered trademarks which appear on this website. Use of these trademarks will infringe our intellectual property rights.

Amendment of terms and conditions

These terms and conditions may be amended in whole or in part by Alertus from time to time. Amendments are effective immediately upon posting of the amended terms and conditions on the Alertus website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the Alertus services represents your agreement to be bound by the terms and conditions as amended.

System integrity

Alertus will use its reasonable endeavours to ensure the availability of the Website and Services, subject to any downtime required for maintenance. However, Alertus takes no responsibility for any system unavailability, or for any loss that is incurred as a result of Website or Services being unavailable. Further, Alertus assumes no responsibility for the corruption of any data or information held by Alertus.

Force majeure

Alertus has no liability for any lack of performance, unavailability or failure of the Services or the Website, or for any failure of Alertus to comply with these terms and conditions where the same arises from any cause reasonably beyond the control of Alertus.

No waiver

If we do not exercise or enforce any right available to us under these terms and conditions, it does not constitute a waiver of those rights.

Partial invalidity

If any provision of these terms and conditions becomes or is held to be invalid, unenforceable or illegal for any reason, and in any respect, that provision shall be severed from the remaining terms and conditions, which shall continue in full force and effect.

Governing law

These terms and conditions are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the Courts of New Zealand.

Entire agreement

These terms and conditions supersede all previous conditions, understandings, commitments, agreements and representations whatsoever whether oral or written, and constitutes the entire agreement, between the parties, relating to the subject matter of these terms and conditions.
